Student Enrollment Terms and Conditions

These Student Enrollment Terms andConditions ("Terms") are an agreement between The Brem Method, LLC("TBM," "we," "us," or "our") and theindividual student who enrolls in the applicable course ("Student,""you," or "your"). They govern enrollment in and use ofTBM's Live MCAT Prep Course and Foundations, including retail andinstitution-sponsored offerings of those courses. Please read them beforeenrolling and retain a copy.
Your enrollment is a purchase of a course,not a month-to-month subscription. Voluntary withdrawal generally does notcancel unpaid installments. Student-requested refunds are discretionary andsubject to the restrictions in Section 4. Different remedies apply when TBMcancels or materially reschedules a course, as described in Section 6. Nothingin these Terms limits rights or remedies that applicable law does not permit usto waive or restrict.
1 Scope and acceptance
1.1Covered services. A "Course" means theLive MCAT Prep Course or Foundations offering identified in your enrollment."Services" means that Course and the instruction, coaching,materials, recordings, platform access, communications, and third-party resourcesincluded in your purchase. These Terms do not govern separately purchasedstandalone 1:1 coaching, Exam Essentials, or other TBM products. Coachingincluded within a covered Course is governed by these Terms.
1.2Personal enrollment. You must be at least eighteen(18) years old and legally able to enter into this agreement. You must enrollusing your own accurate information and personally accept these Terms throughTBM's checkout or enrollment process. Another individual may not accept them onyour behalf, purchase an enrollment for later transfer, or substitute anotherparticipant. An institution may arrange or fund your enrollment, but you mustpersonally accept these Terms before participating or accessing the Services.
1.3Payment by another person. With the cardholder's oraccount holder's authorization, you may use another person's payment method.That person does not become the Student or obtain course access. You remainresponsible for your agreed student payment obligations. Any authorization requiredfrom the payment-method holder, including authorization for recurring payments,must also be obtained; your acceptance alone does not substitute for thatauthorization.
1.4Enrollment details. The course description, price,student payment responsibility, payment schedule, start and end dates, timezone, included resources, access periods, and any applicable institutionalsponsor or affiliate presented before you enroll are the "EnrollmentDetails" and form part of this agreement. "Course Start Date"means the start date specified there. Course-specific Enrollment Detailscontrol those subjects if they differ from these general Terms, except thatthey may extend but may not shorten the one-year access period for recordingsand TBM platform materials described in Section 2.2. Third-party resourceaccess periods may differ. A special refund or other exception controls only ifexpressly identified before purchase or confirmed by an authorized TBM representativein writing. An order confirmation may confirm, but may not unilaterally addmaterially different terms to, your purchase.
1.5Electronic acceptance. Checking the acceptance boxor completing another affirmative acceptance process presented by TBM signifiesyour agreement to these Terms. Electronic acceptance has the same intendedeffect as a signature. You may download or request a copy. TBM may retainrecords of the accepted version, acceptance date, and associated enrollment.
2 Course services and access
2.1Included services. You receive only the servicesand resources listed in your Enrollment Details. UWorld, Mistake to Mastery,coach meetings, coach review sessions, messaging support, and other resourcesare included only when listed. AAMC materials are not automatically included;they must be separately selected and purchased if offered at checkout.References to services available in other TBM courses do not add them to yourpurchase.
2.2Access period. Subject to these Terms, recordingsmade available for your Course and TBM materials housed in Xperiencify or areplacement learning platform remain accessible for one (1) year after yourCourse ends. Live instruction, coaching, and messaging support are providedduring the periods stated in the Enrollment Details; the recording-accessperiod does not extend live support. Third-party resource access follows itsseparately disclosed period and activation rules. Continued availability ofevery individual live-session recording is not guaranteed if a recording failsor must be removed for privacy or legal reasons; TBM will use reasonableefforts to provide equivalent instructional material for a material gap.
2.3Third-party resources. Resource providers mayrequire separate account activation and acceptance of their terms and privacynotices. You must complete required activation steps and comply with thoseterms. Activation and expiration dates may differ from Course dates. Failure toactivate or use a resource does not extend its stated access period or create arefund right. TBM's express obligations to you remain subject to Sections 6 and17 if a provider becomes unavailable.
2.4Personal use. Access is limited to you. You mustprotect your credentials and promptly report suspected unauthorized access. Youmay retain and use for personal study materials that you lawfully downloadedduring your access period with TBM's express permission, including after onlineaccess expires, subject to the continuing restrictions in Section 8 and anyapplicable third-party license. Streaming access does not authorize downloadingor making your own recordings.
3 Price and payment
3.1Agreed price. You agree to pay the student priceand applicable taxes disclosed at checkout. If you select payment in full, thefull amount is due at enrollment. If you select a TBM installment plan, thetotal course price may differ slightly from the payment-in-full price for thesame enrollment and eligible discount solely to allow the installments to bestated in equal, rounded amounts. The exact installment-plan total, initialpayment, number of later payments, payment amounts, and due dates will bedisclosed before you purchase and included in your enrollment confirmation. Anydifference will be included in the disclosed installment-plan price; TBM willnot add an undisclosed interest charge, financing premium, or setup orprocessing fee. Any legally required financing disclosures and separatelyaccepted payment authorization supplement these Terms. We will not impose alate-payment penalty under these Terms; permitted actual collection expensesare addressed in Section 3.7.
3.2Full purchase obligation. An installment plandivides the agreed purchase price into payments; it is not a cancellablemonthly subscription. Except where these Terms, a written TBM approval, orapplicable law provide otherwise, you owe the full agreed student price even ifyou withdraw, stop attending, do not use the resources, or finish preparing forthe MCAT before the payment schedule ends. Installments may continue after theCourse ends. No new course or subscription automatically renews through thisagreement.
3.3Automatic payments. When you choose an automaticinstallment plan and complete the applicable payment authorization, youauthorize TBM and its payment processor to charge the authorized payment methodfor the scheduled amounts on the disclosed dates, with lawful retries forunpaid charges. TBM will provide a copy of the payment schedule andauthorization. You must maintain accurate payment information. Additionalpurchases, renewal resources, or other amounts outside the authorizationrequire separate authorization before an automatic charge.
3.4Revocation and alternatives. You or thepayment-method holder may contact jubal@bremmethod.com to revokeautomatic-payment authorization or arrange a permitted alternative paymentmethod. TBM will honor revocation and stop-payment rights under applicable lawand payment-network rules. Revocation does not itself cancel the enrollment oran otherwise valid debt; amounts remain due on the agreed schedule. Wherelegally required, TBM will offer a nonautomatic repayment method and will notcondition credit on recurring electronic withdrawals.
3.5Failed payments. After four (4) unsuccessful,permitted attempts to collect the same overdue installment, TBM may suspendaccess and will notify you of the unpaid amount. All attempts and retriesremain subject to valid authorization, applicable law, and payment-processorrules. If further collection attempts are not permitted, TBM may insteadsuspend access if the overdue amount remains unpaid after written notice givingyou at least ten (10) calendar days to pay through an available lawful paymentmethod. Revoking automatic-payment authorization is not itself a paymentdefault if amounts are paid when due. TBM may terminate enrollment for anuncured payment default after written notice stating that consequence andgiving you at least ten (10) calendar days to pay. Restoration of accessremains governed by Section 3.6. Suspension or termination does not acceleratefuture installments; they remain due only on their existing schedule unlessotherwise agreed in writing or required by law.
3.6Restoration. Once all overdue installments arepaid, TBM will promptly restore any remaining, unexpired access suspended orterminated solely for nonpayment. Restoration does not restart access periodsor entitle you to make-up sessions for services missed while in default. Aseparate restriction for misconduct may remain in effect under Section 9.
3.7Disputes and collection costs. Please notify TBMpromptly of a billing concern so we can investigate. Nothing requires you tocontact TBM before exercising lawful bank, cardholder, chargeback, orconsumer-protection rights or limits the time allowed by law. To the extentpermitted by law, you are responsible for reasonable, documented, actualthird-party processing and collection expenses, including reasonable attorneys'fees, incurred to collect a valid overdue balance. Chargeback-related fees maybe recovered only to the extent lawfully recoverable for a fraudulent orbad-faith dispute, not merely because you disputed a charge or lost a dispute.No amount may be recovered twice, and statutory rights to recover attorneys'fees are preserved.
3.8Institutional funding. Your responsibility islimited to the student-paid portion disclosed before you enroll. You do notguarantee a sponsor's payment, minimum enrollment, or purchase of otherstudents' seats. A sponsor's failure to pay does not automatically transfer itsobligation to you. Refunds of sponsor-paid amounts are handled with the sponsorunder its separate agreement and are not payable to you.
4 Student withdrawals and refund requests
4.1Discretionary requests. There is no generaldeadline to submit a refund request, but submitting a request does notestablish eligibility or a right to a refund. Except for Section 6 or rightsrequired by law, refunds require TBM's written approval and may be approved ordenied in TBM's discretion, exercised in good faith. This policy applies toinitial payments as well as later installments.
4.2Access and attendance cutoff. Once, on or after theCourse Start Date, you either attend any session of that Course, including anorientation or review session, or log into the learning platform to access thatCourse, you are no longer eligible for a student-requested refund unless TBMexpressly approves an exception in writing or applicable law requires a refund.A failure to attend or log in does not create automatic refund eligibility. Anapproved refund under Section 6 is not subject to this cutoff.
4.3Deductions. For an approved student-requestedrefund, TBM will deduct actual, unrecoverable payment-processing fees and TBM'snonrecoverable cost of resources already activated or irrevocably redeemed foryour enrollment, including UWorld, Mistake to Mastery, AAMC, or otherapplicable resources. TBM will provide an itemized calculation, will not deductthe same cost twice, and will not deduct a cost it recovers from a provider. Nodeduction applies where prohibited by law.
4.4Installment adjustments. Unless a differentarrangement is expressly agreed in writing, approval of a withdrawal refundcancels future course installments. TBM will apply the permitted deductions toamounts already paid and refund any remaining balance. If the permitted activated-resourcecosts exceed what you have paid, you remain responsible for that documenteddifference to the extent lawful; processing-fee deductions alone will notcreate an additional balance. TBM will disclose the calculation in the refundapproval and will not automatically charge a new amount without appropriateauthorization.
4.5Request and processing. Send refund requests tojubal@bremmethod.com with your name, Course, and reason for the request. TBMwill ordinarily initiate an approved refund to the original payment methodwithin ten (10) business days after approval, or sooner if required by law. Thepayment provider may take additional time to post it. If the original method isunavailable, TBM will arrange an appropriate verified alternative. TBM mayterminate Course access when a refund is approved, except for third-partyresources you lawfully retain.
4.6Withdrawal without a refund. If you voluntarilystop participating without an approved refund, you retain your remaining accessfor its original duration, subject to payment and conduct requirements. Unpaidinstallments remain due. Changes to your MCAT date, application plans, personalschedule, or study preferences do not themselves create refund, credit,extension, or free-repeat rights.
4.7Bundles. Where you purchase more than one Coursetogether, refund eligibility and access cutoffs are assessed for each affectedCourse. The Enrollment Details will disclose how the total purchase price isallocated among the Courses and any separately priced resources. Payments andpermitted deductions will be allocated consistently with that disclosure. Acost for a resource shared across Courses will not be deducted more than once.An approved refund or cancellation affecting one Course adjusts only the portionof the payment obligation attributable to that Course unless TBM agreesotherwise in writing or applicable law requires otherwise. TBM will notretroactively reprice completed services to impose an undisclosed penalty.
5 Deferrals and enrollment transfers
5.1Approval required. Enrollment may not betransferred to another person. You may request a deferral to a later offeringby emailing anastasia@bremmethod.com. There is no fixed request deadline, buteach deferral is discretionary, subject to availability, and effective onlywhen TBM confirms the receiving Course and conditions in writing. Repeateddeferrals may be approved, but no unlimited or indefinite deferral entitlementis promised.
5.2Price and payments. TBM does not charge a separatedeferral fee. If the receiving Course has a higher price, you must pay thedifference disclosed in the approval; if it costs less, you do not receive arefund or credit of the difference. Your existing payment schedule continuesunless TBM approves a change in writing. A deferral does not undo a previouslyreached refund cutoff.
5.3Resource access. Activated third-party accessperiods continue running during a deferral and do not reset. If access expiresbefore or during the receiving Course, replacement or renewal resources areyour responsibility at the then-current price disclosed before purchase. Adeferral approval will identify the revised TBM platform-access period and anychanges to included resources. A transfer offered because TBM cancels ormaterially reschedules is governed by Section 6 instead.
6 TBM changes and cancellations
6.1Course administration. TBM may change instructors,coaches, platforms, curriculum, teaching methods, and resource providers, andmay make reasonable changes to individual session dates. We will notify you ofscheduling changes and use reasonable efforts to provide a recording, make-upsession, or equivalent instruction for an affected session. These changes donot require your approval, but they do not permit TBM to materially reduce theServices purchased without an appropriate replacement or remedy.
6.2Cancellation and material rescheduling. If TBMcancels your Course or materially changes its overall schedule, we will notifyyou and offer a choice between a refund under Section 6.3 and transfer to anavailable, reasonably comparable TBM course without an additional course fee.For a rescheduled Course, you may also choose to continue on the revisedschedule. The refund option is available upon notification and does not dependon discretionary approval under Section 4. You are not required to accept atransfer or revised schedule. If, after receiving written notice of the changeand these options, you affirmatively accept the revised schedule or a specifiedtransfer in writing, including electronically, that acceptance resolves yourrefund or transfer choice arising solely from that disclosed change. It doesnot waive rights arising from later changes, nonperformance, other provisionsof these Terms, or applicable law. Silence alone does not constituteacceptance. A reasonable change to an individual session, accompanied by anappropriate recording or make-up option, is not ordinarily a material change tothe overall schedule. If TBM materially reduces the promised Services andcannot provide an appropriate replacement, we will provide a refund for theundelivered portion or another remedy you agree to, without restricting greaterrights required by law.
6.3Refund calculation. If you choose a refund underSection 6.2 because TBM cancels your Course or materially changes its overallschedule, TBM will cancel unpaid installments for the affected Course andrefund amounts you paid for it, except that TBM may deduct its documented,nonrecoverable cost of already activated third-party resources that remainavailable for your continued use, to the extent permitted by law. Thisdeduction will not exceed the amount you paid and will not create a new debt.No processing fees will be deducted. We will not deduct for resources that arerevoked or unusable because of the cancellation, or where law requires a fullrefund. Refunds will be initiated within ten (10) business days after yourrefund selection, subject to any shorter legal deadline. Online access to therefunded TBM Services ends when the refund is initiated, except for third-partyresources you lawfully retain.
6.4Transfer arrangements. A transfer accepted underSection 6.2 will be confirmed in writing and will state the new dates, accessperiods, and treatment of third-party resources. Amounts already paid for theaffected Course will be credited toward the replacement Course, and unpaidinstallments will remain due on their existing schedule unless TBM confirms adifferent schedule in writing. The transfer does not increase the agreed courseprice. Any optional resource purchase must be disclosed and accepted before itis charged. A transfer is not presumed from silence. Sponsor-funded amountsremain governed by the sponsor's separate agreement; any student refund islimited to amounts paid through the student payment arrangement and excludesthe sponsor's separate contribution.
7 Participation and coaching
7.1Student responsibilities. You are responsible forattending, completing assigned work, booking included meetings, monitoringcourse communications, and meeting any disclosed technical requirements. Youmust provide a suitable device and reliable internet connection. TBM does notcontrol your personal equipment, connection, testing eligibility, or admissionsdecisions.
7.2Included coach meetings. The number, duration, andavailability of included meetings are stated in the Enrollment Details. Unusedmeetings, missed appointments, and appointments canceled with less thantwenty-four (24) hours' notice are forfeited, except where TBM approves an exceptionor law requires otherwise. Forfeiture does not apply when TBM or a coachcancels a meeting or when you timely request an included meeting and TBM cannotprovide reasonable booking availability; Section 7.3 applies instead. Except asprovided in Section 7.3, meetings do not accumulate, carry forward, convert tocash, or convert to other services.
7.3TBM cancellations. A meeting canceled by TBM or acoach does not count as used or forfeited. The coach will use reasonableefforts to reschedule it within the applicable support period or anothermutually agreed period. If rescheduling is not reasonably possible, TBM willoffer equivalent support or an appropriate refund or credit for the undeliveredmeeting. Messaging support, where included, is not continuous or emergencysupport.
8 Intellectual property and permitted use
8.1Ownership and license. TBM and its licensors retainall rights in course materials, recordings, presentations, workbooks,instructional methods, assessments, software, branding, and other proprietarycontent ("Course Content"). Subject to these Terms, you receive a limited,nonexclusive, nontransferable license to use Course Content solely for your ownpersonal study during the applicable access period, with the permittedretention of authorized downloads under Section 2.4. You do not acquireownership of Course Content or rights to teach, sell, or license it.
8.2Prohibited activities. Except as expresslyauthorized in writing or permitted by nonwaivable law, you may not shareaccounts or access links; sell, publish, distribute, upload, or sublicenseCourse Content; create or distribute derivative teaching products; record orscreen-capture sessions or streaming materials; remove ownership notices;scrape or automatically extract content; bypass access controls; reverseengineer protected software; or introduce malware or interfere with theServices. Do not copy or upload third-party practice questions in violation ofthe provider's license.
8.3Artificial intelligence tools. You may not uploador input Course Content, recordings, protected assessment items, or anotherparticipant's information into generative AI services, AI note-taking bots,model-training systems, or similar tools without TBM's prior writtenpermission. This restriction does not prevent use of approved accessibilitytools or exercise of nonwaivable legal rights. Approval of an accessibilitytool does not authorize sharing recordings or content with others.
8.4Your work and protected disclosures. You retainownership of your original submissions, subject to TBM's underlying CourseContent. You grant TBM and the service providers acting for it the limitedrights necessary to host, reproduce, display, and use those submissions todeliver, support, and administer the Course. Recording and marketing uses arelimited by Section 10. These Terms do not prohibit honest reviews, lawfulcomplaints, reports to authorities, or legally protected disclosures to yourlawyer or other advisor. They do not transfer ownership of your reviews to TBM.
9 Conduct and enforcement
9.1Course environment. You must treat instructors,staff, and other students respectfully. Harassment, discrimination, threats,fraud, impersonation, content theft, unauthorized account sharing, and conductthat materially disrupts instruction or threatens safety or security areprohibited. Do not disclose another student's private information, questions,or personal experiences outside the Course without permission, except forlawful protected disclosures.
9.2Enforcement. For a less serious, correctableviolation, TBM will ordinarily provide a warning and reasonable opportunity tocorrect it. TBM may immediately restrict or terminate access for a seriousviolation, including harassment, threats, fraud, unauthorized recording,account sharing, or content theft, or for repeated disruption after warning.TBM may temporarily restrict access while investigating a credible safety orsecurity concern and will communicate its decision when reasonably practicable.You may request review by emailing jubal@bremmethod.com.
9.3Financial effect. To the extent permitted by law,termination for your material breach does not create a refund entitlement orrelease otherwise valid unpaid installments. TBM will not treat a good-faithcomplaint, honest review, accommodation request, or exercise of lawfulpayment-dispute rights as misconduct. TBM cancellation unrelated to your breachremains subject to Section 6.
10 Recordings and student contributions
10.1Recording consent. Live classes, orientations, andcoach review sessions may be recorded. Recordings may capture your name, image,voice, questions, chat messages, and other contributions. By accepting theseTerms and participating in a session identified as recorded, you consent torecording and the uses described in this Section. TBM will provide notice whena session is recorded and obtain any additional consent required by law.Separate individual coaching meetings are not covered by this recordingpermission unless separately disclosed and agreed.
10.2Course use and participation choices. Recordingscontaining identifiable student participation may be accessed by enrolledstudents in the same Course cohort, authorized TBM personnel, and serviceproviders as necessary to deliver and administer the Services. They will not bemade available to unrelated future cohorts without separate permission orremoval of identifiable participation. You may keep your camera and microphoneoff. Your display name and chat contributions may still appear; contact TBMbefore participating if you need another way to ask a private question oraddress a recording concern.
10.3Limited marketing use. TBM may use limited excerptsfor marketing only after removing or altering identifying information so youcannot reasonably be recognized from the excerpt or its context. This includesconsidering your face, voice, displayed name, written messages, and distinctivepersonal details; removing your name alone may not be sufficient. These Termsdo not authorize identifiable student endorsements, testimonials, images, orrecordings in advertising. Such use requires a separate, optional permissionand is not a condition of enrollment.
10.4Other participants. Students are prohibited frommaking unauthorized recordings or distributing another participant'sinformation. TBM cannot guarantee that every participant will comply, but mayenforce these Terms when it learns of a violation. Avoid sharing sensitive personaldetails in group sessions or public course channels.
11 Student information and privacy
11.1Information used. In connection with enrollment anddelivery, TBM may process your name, contact details, enrollment and billingrecords, account identifiers, attendance, course activity, lesson completion,engagement, submitted work, assessments, communications, recordings, andtechnical information generated by the platforms you use. Payment informationis processed through the applicable payment provider. Do not submitpayment-card details, identification documents, or sensitive health informationthrough course chats; contact TBM privately where such information is necessaryfor an approved process.
11.2Purposes and service providers. TBM may use thisinformation to administer enrollment, process payments, provide and supportinstruction, communicate with you, measure course engagement, maintainsecurity, comply with law, and resolve disputes. We may disclose information topersonnel and service providers as reasonably necessary for those purposes,subject to appropriate confidentiality and data-protection obligations.Separately activated third-party services may process information under theirown notices and terms. Institutional reporting and recording-related marketingare limited by Sections 12 and 10, respectively.
11.3Other disclosures. TBM may disclose informationwhen required by law or valid legal process, or as lawfully necessary toinvestigate fraud, protect safety, or establish or defend legal rights. TheseTerms do not authorize selling your identifiable course records, disclosingthem to unrelated advertisers, or using your identifiable submissions to traingeneral-purpose AI models.
11.4Security and retention. TBM will maintainreasonable safeguards appropriate to the information it handles and requireappropriate safeguards from service providers. No electronic system iscompletely secure. We retain identifiable information only as reasonably neededfor the purposes described here, course access, applicable institutionalobligations, legal requirements, and legitimate recordkeeping or disputeresolution, then delete or de-identify it as appropriate. Backup deletion mayfollow normal secure retention cycles, subject to applicable legal andcontractual requirements. This provision does not promise immediate erasure ofevery backup or require retention of identifiable course records for the fullonline-access period where earlier deletion is legally required.
11.5Requests and additional disclosures. Contactjubal@bremmethod.com with privacy questions or requests to access, correct, ordelete information. TBM may verify your identity and will respond as requiredby applicable law. Some information may need to be retained for lawfulpurposes, and some requests involving institution-controlled records mayrequire coordination with that institution. Any applicable privacy noticeprovided by TBM supplements these disclosures; a later notice does not itselfauthorize a materially incompatible new use of previously collectedinformation. Additional disclosures or consents will be provided whererequired. Acceptance of these Terms is not a blanket waiver of privacy rights.
11.6De-identified information. TBM may create and useaggregated or de-identified information for lawful analysis and improvement ofthe Services, provided it cannot reasonably identify you or another individual.TBM will not attempt to re-identify such information except where lawfullynecessary to test the effectiveness of de-identification, and will apply anyadditional safeguards required by law.
12 Sponsored programs and affiliate discounts
12.1Separate arrangements. A school, university, orother organization may sponsor enrollment or offer an affiliate discount. TBM'sagreement with that organization is separate from these Terms and does not makeyou liable for its obligations. Course-specific participation requirements andany student payment responsibility must be disclosed before your acceptance.
12.2Limited reporting. If the Enrollment Detailsidentify an institutional sponsor or affiliate, by accepting these Terms forthat enrollment, you authorize TBM, to the extent legally permitted, to sharewith the identified organization's designated contact: your name, email address,Course or program, enrollment date and status, affiliate code used, andattendance and engagement information. Selecting the sponsored program or usingits discount code identifies the applicable program or affiliate arrangement;your reporting authorization arises from your acceptance of these Terms.Reporting is for administering and evaluating the identified program oraffiliate arrangement. This Section identifies the categories and purposes ofthe reporting, and the Enrollment Details identify the recipient. No separatereporting disclosure is required unless applicable law requires a specific formof consent.
12.3Additional information and consent. Academicprogress reports beyond the attendance and engagement information above,assessment results, MCAT scores, private coaching notes, and the contents ofprivate communications are not included in this reporting permission. Sharingthem requires separate disclosure and authorization or another lawful basis.Where law requires a specific form of consent, TBM will obtain it separately;using a code alone is not a substitute. Nothing here overrides restrictionsthat apply to institutional education records.
13 Accessibility and accommodations

TBM will consider requests individually and providereasonable modifications, auxiliary aids, or other accessible arrangements asrequired by applicable law. TBM may discuss effective alternatives with you anddoes not guarantee every preferred accommodation. Advance notice helps usarrange support, but late requests will still be considered. TBM will notcharge you extra for an accommodation that applicable law requires us toprovide without charge. This request process does not replace TBM's applicableobligations to provide accessible course delivery. These Terms do not waiveaccessibility rights. TBM does not decide accommodations for the official MCATor another organization's examination.
14 Educational outcomes and warranty limitations
14.1No outcome guarantee. Results depend on individualpreparation, participation, circumstances, and factors outside TBM's control.TBM does not guarantee a score or score increase, admission, course completion,an academic or professional outcome, or a free repeat. Examples of otherstudents' outcomes are not promises of your results. You remain responsible forconfirming testing and application requirements with the relevantorganizations.
14.2Limited warranties. EXCEPT FOR EXPRESS COMMITMENTSIN THESE TERMS OR YOUR ENROLLMENT DETAILS, AND TO THE EXTENT PERMITTED BY LAW,THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TBMDISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULARPURPOSE, TITLE, AND NON-INFRINGEMENT. TBM DOES NOT WARRANT UNINTERRUPTED ORERROR-FREE PLATFORM ACCESS, COMPLETE OR ERROR-FREE REPORTS, OR FREEDOM FROMEVERY SECURITY THREAT OR DATA LOSS.
14.3Preserved obligations. These disclaimers do noteliminate TBM's obligation to provide the purchased Services, honor expressrefund commitments, maintain required safeguards, or comply with applicablelaw. No statement here excludes a warranty or consumer remedy that cannot lawfullybe excluded.
15 Limitation of liability
15.1Monetary cap. TO THE FULLEST EXTENT PERMITTED BYLAW, TBM'S AND ITS OFFICERS', EMPLOYEES', CONTRACTORS', AND AGENTS' COMBINEDAGGREGATE LIABILITY TO YOU ARISING FROM A COURSE OR THESE TERMS WILL NOT EXCEEDTHE TOTAL AMOUNT ACTUALLY PAID TO TBM FOR YOUR ENROLLMENT IN THE AFFECTEDCOURSE, INCLUDING AMOUNTS PAID ON YOUR BEHALF. THIS IS A SINGLE COMBINED LIMIT,NOT A SEPARATE LIMIT FOR EACH CLAIM OR PERSON. FOR A SPONSORED SEAT, ITINCLUDES SPONSOR FEES ATTRIBUTABLE TO YOUR SEAT, NOT FEES FOR OTHER STUDENTS.
15.2Excluded damages. TO THE FULLEST EXTENT PERMITTEDBY LAW, TBM AND THOSE PERSONS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL,SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING CONSEQUENTIALLOSS OF INCOME, OPPORTUNITY, OR DATA, ARISING OUT OF THE SERVICES, REGARDLESSOF THE LEGAL THEORY OR WHETHER SUCH DAMAGES WERE FORESEEABLE.
15.3Exceptions. These limits do not restrict expressrefund obligations, liability for fraud, willful misconduct, or grossnegligence, or any liability or remedy that cannot be limited under applicablelaw. They do not limit your statutory privacy, payment-dispute, accessibility,or consumer-protection rights where such a limitation is prohibited. A courtwill apply these provisions only to the extent enforceable.
16 Disputes and governing law
16.1Informal resolution. Before filing a lawsuit, youand TBM agree to send written notice describing the dispute, relevantenrollment, and requested resolution, and to attempt in good faith to resolveit for thirty (30) days after receipt. Send your notice to jubal@bremmethod.com.TBM will send its notice to your enrollment email. This process does notprevent a small-claims filing, a government complaint, a lawful paymentdispute, urgent court relief, or a filing needed to preserve a legal deadline.It does not shorten any statutory deadline.
16.2Law and courts. Utah law governs these Termswithout regard to conflict-of-laws rules, except that you retain mandatoryprotections of other applicable law that cannot be displaced by contract.Unless law requires otherwise, disputes will be brought in the state or federalcourts located in Salt Lake County, Utah, and you and TBM consent to theirjurisdiction. Either party may use a court with appropriate small-claimsjurisdiction where permitted by law. These Terms do not require arbitration orwaive participation in a class action.
16.3Equitable relief. Either party may seek appropriateinjunctive or other equitable relief from a court for misuse of confidentialinformation, infringement, unauthorized content distribution, or other conductfor which such relief is legally available. The requesting party must satisfyapplicable legal requirements.
17 Events beyond reasonable control
Neither party is responsible for a delay orfailure to perform to the extent caused by an event beyond its reasonablecontrol, such as a natural disaster, serious widespread outage, epidemic, war,or governmental restriction, provided it gives reasonably prompt notice anduses reasonable efforts to mitigate the effect. Valid payment obligations underan existing enrollment remain due on the agreed schedule, except to the extentreduced or canceled under these Terms or applicable law. This provision doesnot permit TBM to retain payments for canceled Services contrary to Section 6or excuse duties that law does not allow to be waived. If an event causes TBMto cancel or materially reschedule the overall Course, Section 6 applies.Ordinary personal scheduling conflicts, changes in test plans, or inability topay do not themselves create a force majeure excuse. TBM will not use thisSection to impose an indefinite postponement without the options provided inSection 6.
18 Communications and notices
18.1Service communications. TBM may send enrollmentconfirmations, payment notices, schedule changes, coaching messages, reminders,and other necessary service communications to your enrollment email or throughthe course platforms. You must keep your contact information current.
18.2Contact information. Routine enrollment questions,deferrals, and accommodation requests should be sent toanastasia@bremmethod.com. Refund requests, formal notices, disputes, privacyrequests, and payment-authorization matters should be sent tojubal@bremmethod.com. Written notices may also be sent to The Brem Method, LLC,PO Box 17713, Salt Lake City, UT 84117. Notices are effective upon receipt,except where applicable law provides otherwise. Legally required service ofcourt documents must follow the applicable rules.
19 Duration and general provisions
19.1Duration and survival. These Terms begin when youaccept them and continue through your enrollment, the applicable accessperiods, and resolution of outstanding obligations. Ending attendance orplatform access does not eliminate valid unpaid amounts or rights alreadyaccrued. Provisions concerning payment, refunds, retained downloads,intellectual property, authorized retention and use of information,confidentiality of other students' information, liability, disputes, andgeneral legal administration survive to the extent necessary to fulfill theirpurposes. Survival does not extend a license or permit retention or use ofpersonal information beyond its stated limits.
19.2Agreement and changes. These Terms, your EnrollmentDetails, and any separately accepted applicable payment authorization orwritten enrollment exception form the agreement concerning your purchase. Theydo not eliminate enforceable pre-purchase representations or mandatory disclosures.The version you accepted governs that enrollment. TBM may publish updated termsfor future enrollments, but material changes to an existing enrollment requireyour affirmative agreement, except for changes legally required or alreadypermitted by these Terms. A later privacy notice does not amend the payment orrefund agreement.
19.3Severability and waiver. If a provision isunenforceable, the remainder continues to the extent legally permitted. Afailure to enforce a provision on one occasion is not a waiver on another. Aspecific written exception applies only to its stated circumstances.
19.4Assignment and beneficiaries. You may not assignyour enrollment or access to another person. TBM may transfer this agreement inconnection with a business sale or reorganization if the successor assumes itsobligations and the transfer does not diminish your rights. No third party hasrights under these Terms except the TBM personnel expressly protected bySection 15. Separate institutional agreements and resource-provider agreementsremain separate and do not authorize an undisclosed increase in yourobligations.
19.5Applicable law controls. If these Terms conflictwith a nonwaivable legal right or duty, applicable law controls. In particular,refund, automatic-payment, collection, recording, privacy, accessibility, andliability provisions apply only to the extent lawful in the circumstances ofyour enrollment.
